Abstract

ABSTRAK Indah Dwi Jayanti, 2019, NIT : 52155886 K “Analisis Pentingnya Status Hukum Hukum Kapal Guna Mewujudkan Keselamatan Pelayaran di Pelabuhan Tanjung Emas Semarang”, skripsi Program Studi Ketatalaksanaan Angkutan Laut dan Kepelabuhanan, Program Diploma IV, Politeknik Ilmu Pelayaran Semarang, Pembimbing I : Daryanto, S.H, M.M, Pembimbing II : Andy Wahyu Hermanto, M.T. Status hukum kapal merupakan suatu proses pengukuran kapal, pendaftaran kapal, dan penetapan kebangsaan kapal. Setiap kapal wajib dilakukan pengukuran yang akan disahkan oleh pejabat pemerintah yang di beri kemenangan oleh Menteri. Pendaftaran kapal meliputi hak milik, pembebanan hipotek dan pendaftaran hak kebendaan lainnya diatas kapal. Kapal yang telah memenuhi persyaratan akan di nyatakan laik laut . Laik laut adalah keadaan kapal yang memenuhi persyaratan material, konstruksi, bangunan, pemersinan, dan perlistrikan, statibilitas, susunan serta perlengkapan termasuk perlengkapan alat penolong dan radio , elektronik kapal, yang dibuktikan dengan sertifikat setelah dilakukan pemeriksaaan dan pengujian. Identitas kapal secara fisik diperlihatkan dengan bendera kebangsaan kapal. Dengan kapal yang sudah dinyatakan laiklaut maka dapat meningkatkan keselamatan kapal. Mengingat pentingnya status hukum kapal dalam hal ini penulis menggunakan metode penelitian deskripstif kualitatif untuk mengidentifikasi pentingnya status hukum kapal bagi keselamatan pelayaran , sedangkan tujuan dari penelitian deskriptif kualitatif searah dengan rumusan masalah serta pertanyaan penelitian atau identifikasi masalah. Hal ini disebabkan tujuan dari penelitian ini akan menjawab pertanyaan yang sebelumnya dikemukakan oleh rumusan masalah serta pertanyaan penelitian. Tujuan ini juga menentukan bagaimana mengolah hasil penelitian yaitu dengan membuat analisisnya memakai metode penelitian ini. Dengan memahami prosedur serta tata cara mendapatkan status hukum kapal tersebut, diharapkan para owner kapal memahami dan dapat melaksanakan sesuai dengan prosedur sehingga kapal dapat disebut laik laut serta dapat mewujudkan keselamatan berlayar pada saat kapal beroperasi. Ship's legal Status is a process of measuring vessels, ship registration, and national designation of vessels. Each vessel is obliged to be measured that legalized by a government official which have authorit from the minister. Ship registration includes proprietary, mortgage loading and other material rights registration on board. The vessel that has fulfilled the requirements will be declared seaworthy. Seaworthiness is a vessel that qualified in material, construction, building, alignment, and electricity requirements, statibility, arrangement and equipment including auxiliary and radio equipment, ship electronics, evidenced by After the examination and testing. The identity of the vessel is physically shown by the ship's national flag. With a ship that has been declared seaworthy then can improve the safety of the ship. Considering of the importance of the ship's legal status in this case the authors use a qualitative descriptive research method to identify the importance of ship's legal status for the safety of the cruise, while the goal of qualitative descriptive research as well as formulation of the problem and the question of research or identification problems. This is because the purpose of this research will answer the previosly question which expressed by the formulation of problems as well as research questions. This purpouse also determines how to process the research results by making the analysis using this method of research. By understanding the procedures and ordinances of obtaining the legal status of the vessel, the owner is expected to understand and can implement in according to the procedure so that the ship can be called seaworthy and can realize the safety of sailing at the time when the ship operates.
