Abstract

Maritime Lady yang Menabrak Breakwater Teluk Penyu Cilacap”, Skripsi Progam Studi Ketatalaksanaan Angkutan Laut dan Kepelabuhanan, Progam Diploma IV, Politeknik Ilmu Pelayaran Semarang, Pembimbing I: Dr. Winarno, S.ST, M.H., Pembimbing II: Amad Narto, M.Mar.E., M.Pd. Bisnis perkapalan merasakan betapa pentingnya risiko tanggung jawab keuangan yang timbul dari pengoperasian kapal, maka kewajiban pemilik/operator kapal wajib bertanggung jawab terhadap keselamatan penumpang dan muatan yang diangkutnya apabila terjadi kecelakaan sehingga menyebabkan cedera atau menimbulkan kerugian bagi penumpang, maupun kehilangan/kerusakan muatan yang diangkut dan kerugian pada pihak ketiga, yaitu dengan cara mengalihkan risiko (transfer of risk) kepada pihak lain dimana pihak lain sebagai penerima risiko dan mampu mengelola risiko tersebut adalah perusahaan asuransi. Dalam hal ini pemilik maupun operator kapal dapat menjamin risiko-risiko tanggung jawab yang timbul dengan asuransi P & I Club. Tujuan penelitian ini yaitu 1). Untuk mengetahui proses pengajuan klaim asuransi kecelakaan kapal BG. Maritime Lady yang menabrak breakwater Teluk Penyu Cilacap 2). Untuk mengetahui kendala yang dihadapi selama proses klaim asuransi kecelakaan kapal 3). Untuk mengetahui upaya yang harus dilakukan untuk mengatasi kendala yang dialami dalam proses klaim asuransi kecelakaan kapal. Dalam hal ini peneliti menggunakan metode penulisan deskriptif kualitatif untuk menggambarkan dan menguraikan objek yang diteliti. Selain itu penelitian ini juga menggunakan observasi, wawancara dan studi pustaka. Dari hasil penelitian yang peneliti laksanakan, 1). Koresponden (local correspondent) dan independen surveyor melaksanakan proses dan penyelesaian klaim sesuai dengan prosedur dan SOP yang ditetapkan, tetapi terdapat kendala dalam proses dan penyelesaian klaim pada tahapan laporan yang terlambat 2). Kendala yang dihadapi dalam proses dan penyelesaian klaim yaitu kelengkapan dokumen klaim, pemilihan perusahaan kontraktor, dan keadaan sosial ekonomi serta cuaca 3). Adanya upaya yang dilakukan untuk menghadapi kendala yang terjadi. Berdasarkan hasil penelitian yang peneliti laksanakan, peneliti memberikan saran 1). Sebaiknya pemilik atau operator kapal melaporkan kejadian kecelakaan kapal lebih awal agar proses pencarian data lebih akurat dan penyelesaian klaim tersebut lebih efektif dan efesien 2). sebaiknya PT. Pertamina selaku pemilik pemecah gelombang (breakwater) menginvestarisasi dokumen-dokumen kepemilikan agar mempermudah proses perbaikan serta PT. Gillar Jaya melakukan dialog persuasif dengan masyarakat dan bekerjasama dengan BMKG Cilacap untuk memastikan prakiraan cuaca sebelum melakukan kegiatan perbaikan. 3). Meskipun upaya yang dilakukan oleh PT. Spicaputra Sarana dan PT. From the results of the research that the researcher carried out, 1). Local correspondents and independent surveyors carry out the process and settlement of claims in accordance with established procedures and SOP, but there are obstacles in the process and settlement of claims at the late stage of reporting 2). Gillar Jaya conducted persuasive dialogue with the community and collaborated with BMKG Cilacap to ensure weather forecasts before carrying out repair activities. 3). Despite the efforts made by PT.
