Abstract

ABSTRAK Rizal Pandu Oktiawan, 2019, NIT : 52155869.K, “Penerapan Peraturan Ketenagakerjaan Tentang Kontrak Kerja Guna Meningkatkan Kinerja Anak Buah Kapal PT. Indo Shipping Jakarta”. Skripsi Program Studi Ketatalaksanaan Angkutan Laut dan Kepelabuhanan, Program Diploma IV, Politeknik Ilmu Pelayaran Semarang, Pembimbing I: Poernomo Dwi Atmojo, SH., MH, Pembimbing II: Adi Oktavianto, S.T, M.M. PT. Indo Shipping adalah suatu perusahan jasa yang menyediakan pelayanan fokus pada transportasi laut dalam mempersiapkan kapal untuk membawa kargo umum, dan muatan curah. Kontrak kerja menurut Undang-Undang No 13 Tahun 2003 tentang ketenagakerjaan adalah perjanjian antara pekerja dengan pengusaha yang memuat syarat syarat kerja, hak dan kewajiban para pihak. Namun anak buah kapal belum melaksanakan kewajiban secara maksimal perjanjian kerja laut juga hak dan kewajiban yang dapat menimbulkan permasalahan baik yang menimbulkan pelanggaran terhadap isi perjanjian kerja laut antara anak buah kapal dengan PT. Indo Shipping Jakarta yang mengakibatkan perselisihan perburuhan. Sehingga apabila tidak dapat diatasi bisa mengakibatkan berakhirnya hubungan kerja. Penelitian ini bertujuan untuk mengetahui penerapan peraturan ketenagakerjaan tentang kontrak kerja, untuk mengetahui kendala yang dihadapi PT. Indo Shipping Jakarta dalam penerapan peraturan ketenagakerjaan tentang kontrak kerja, dan untuk mengetahui upaya yang dilakukan PT. Indo Shipping Jakarta dalam penerapan peraturan ketenagakerjaan tentang kontrak kerja. Adapun jenis penelitian yaitu deskriptif kualitatif. Metode penelitian yang digunakan adalah observasi, studi pustaka, wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa hak dan kewajiban masing-masing para pihak dalam perjanjian kerja laut yang dilakukan oleh anak buah kapal dengan PT. Indo Shipping Jakarta belum diterapkan secara maksimal Maka para pihak yaitu anak buah kapal dan PT. Indo Shipping Jakarta harus saling melakukan hak dan kewajiban secara timbal balik sesuai yang di perjanjikan dalam perjanjian kerja laut. Adapun kendala yang di hadapi perusahaan anak buah kapal kurangnya pengetahuan terhadap perjanjian kerja laut juga hak dan kewajiban yang sudah tedapat di dalam perjanjian kerja laut yang dapat menimbulkan permasalahan baik yang menimbulkan pelanggaran terhadap isi perjanjian kerja laut antara anak buah kapal dengan PT. Indo Shipping Jakarta yang mengakibatkan perselisihan perburuhan. Serta upaya yang dilakukan PT. Indo Shipping Jakarta apabila anak buah kapal tidak melaksanakan kewajiban perjanjian kerja laut dan melanggar tata tertib perusahaan belum memberikan sanksi tegas kepada anak buah kapal yang melakukan pelanggaran. Indo Shipping is a service company that provides focus services on sea transportation in preparing ships to carry general cargo and bulk cargo. A work contract according to Law No. 13 of 2003 concerning manpower is an agreement between a worker and an employer that contains the terms of the work conditions, the rights and obligations of the parties. However, the crew have not carried out their obligations to the maximum of the sea labor agreement as well as rights and obligations which can cause good problems that lead to violations of the contents of the sea labor agreement between the crew and PT. Indo Shipping Jakarta which resulted in a labor dispute. So that if it cannot be overcome it can lead to the end of the work relationship. This study aims to determine the application of labor regulations concerning employment contracts, to find out the obstacles faced by PT. Indo Shipping Jakarta in the application of labor regulations regarding employment contracts, and to determine the efforts made by PT. Indo Shipping Jakarta in the application of labor regulations regarding employment contracts. The type of research is qualitative descriptive. The research methods used are observation, literature study, interviews and documentation. The results of the study indicate that the rights and obligations of each party in the marine work agreement carried out by the crew of the ship with PT. Indo Shipping Jakarta has not been maximally implemented. The parties, namely the crew and PT. Indo Shipping Jakarta must mutually exercise the rights and obligations reciprocally as promised in the sea labor agreement. As for the obstacles faced by the crew of the ship lack of knowledge of the sea labor agreement as well as the rights and obligations that already exist in the sea labor agreement which can cause good problems that lead to violations of the contents of the sea labor agreement between the crew and PT. Indo Shipping Jakarta which resulted in a labor dispute. As well as efforts made by PT. Indo Shipping Jakarta if the crew of the ship does not carry out the obligations of the sea labor agreement and violates the rules of the company has not given strict sanctions to the crew of the ship who committed the violation.
